A motion was made by Commissioner Cooper, seconded by Commissioner Roberts, to make the <br />conditional use permit findings as listed in the staff report, and to approve Case UP-98-60, subject <br />_ to the conditions listed in Exhibit B. <br />ROLL CALL VOTE <br />AYES: Commissioners Cooper, Maas, Roberts, Sullivan, and Chairperson Kumazan <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-98-76 was entered and adopted as motioned. <br />b. UP-98-57, Sara Lapides <br />Application for non-exempt home occupation permit to allow a marriage and family counseling <br />business located at 4389 Second Street. Zoning for the Property is RM-4,000 Single-Family <br />Residential District. <br />Mr. Iserson referenced a staff report dated October 14, 1998 and highlighted key azeas contained in the <br />report including background information, neighborhood concerns, scheduling, noise, parking, traffic, <br />reevaluation of the home occupation, and public notice. In conclusion, Mr. Iserson, stated that staffs <br />recommendation is to approve Case Up-98-57, subject to the conditions of approval listed in Exhibit B. <br />Discussion ensued relating to safety issues due to potential combative clients, the business hours of <br />operation, and installation of more prominent street numbers at the residence. <br />PUBLIC HEARING WAS OPENED <br />Sara Lapides, the applicant, provided the Commission with a list of neighbors who support her <br />application and aze not opposed to her conducting this business in her residence. She expressed her <br />concurrence with the installation of more prominent street numbers being posted at the residence. She <br />stated that her practice would be limited to 15 hours per week, with her clientele being limited to <br />marriage therapy couples and children who aze coping with divorce or school issues. She further noted <br />that the home atmosphere contributes to her clients' comfort. <br />Peter Graham, 4443-Second Street, expressed concern with a business being allowed in this residential <br />neighborhood, the applicant's violation of the exempt home occupancy permit, and with traffic and <br />parking issues existing in the neighborhood presently. He indicated that there aze problems with pazking <br />during Downtown events, that cars go too fast, and that the applicant should find a commercial location. <br />In response to an inquiry by Commissioner Maas relating to existing problems with Ms. Lapides' <br />business, Mr. Graham stated that thus faz there have been no problems with this business being located <br />in Ms. Lapides' home. <br />PLANNING COMMISSION MINUTES Page 4 October 14, 1998 <br />
