Commissioner Kameny suggested allowing the applicant to market the property with staff resolving <br />issues relating to maintenance of fire road, and with a geotechnical survey to be conducted at the time <br />the property is developed. <br />A motion was made by Commissioner Roberts, seconded by Commissioner Cooper, to make the <br />PUD finding as listed in the staff report; recommend that the project be subject to growth <br />management on a first-come, first serve basis; and recommend approval of the project subject to <br />the conditions listed in Exhibit "B"; requiring immediate inspection of the trees and removal of <br />dirt surrounding the trees; setbacks from the Nelson property line; and that the landscape plan <br />restore the natural slope on Nelson's property. <br />ROLL CALL VOTE <br />AYES: Commissioners Cooper and Roberts <br />NOES: Commissioners Maas, Sullivan and Chairperson Kumaran <br />ABSENT: None <br />ABSTAIN: None <br />The motion failed on 3-2 vote. <br />A motion was made by Commissioner Sullivan, seconded by Chairperson Kumaran, to deny <br />application PUD-98-10, based on non-compliance with the Foothill Road Overlay District <br />guidelines. <br />ROLL CALL VOTE <br />AYES: Commissioners Sullivan and Chairperson Kumaran <br />NOES: Commissioners Cooper, Maas, and Roberts <br />ABSENT: None <br />ABSTAIN: None <br />Commissioner Maas stated she voted "no" due to her request for additional surveys to be performed. <br />The motion failed on a 3-2 vote. <br />A motion was made by Commissioner Cooper, seconded by Commissioner Roberts, that the <br />application be approved pending an updated geotechnical study with a specific geotechnical <br />report with remediations being provided by any subsequent purchaser; a tree report update to be <br />performed with remediation efforts for preserving the trees; setbacks measured from the Nelson <br />property line, a landscape plan showing restoration of the natural slope; and, that specific design <br />of the residence being approved by the Commission with a visual analysis of the proposed house. <br />(The design review application and the Design Guidelines are not approved.) <br />PLANNING COMMISSION MINUTES Page 10 October 14, 1998 <br />
