Commissioner Sullivan expressed his disagreement with the staff report relating to compliance of the <br />Foothill Road Overlay District. He stated that the eight lots that are clustered along Foothill Road do <br />not comply with the Foothill Road Overlay guidelines. <br />Commissioner Sullivan continued by expressing his concern with dirt being disbursed around tree trunks <br />and with the visibility and height of the proposed structure. He expressed disagreement with the <br />calculations done for the FAR and stated the FAR should be calculated based on the flat azea of <br />property. Further, he expressed concern with the geotechnical survey and stated he would not be in <br />support of approving the application. He expressed sympathy for the applicant and all the monies that <br />have been spent on the project. <br />Commissioner Kameny expressed sympathy with the applicant's time and money spent on the project <br />and felt that the geotechnical issues would be resolved. He spoke in support of requiring a new study <br />for any residence built on property. He stated that any dumping of dirt on the property should be <br />removed in order to preserve trees. Further, he stated that due to Mr. Nelson's efforts, he would like to <br />see the fire maintenance agreement left intact. <br />In response to an inquiry by Commissioner Kameny relating to whether the applicant is subject to new <br />fee structures, Ms. Seto responded that the applicant is chazged the fee structure that is applicable at the <br />time of payment. <br />Chairperson Kumazan expressed concern with the visibility of the proposed structure. He stated he <br />would opt for voting on this application after staff provided additional information. He stated that a new <br />_ geotechnical study should be conducted to ensure the safety of the building on property and that the dirt <br />azound the trees should be removed. He stated he is in support of postponing the approval of application <br />until staff provides additional information relating to building on elevations west of Foothill Road. <br />A motion was made by Commissioner Maas, seconded by Chairperson Kumaran, that action be <br />delayed relating to Case PUD-98-10 until a geotechnical study can be conducted, a new tree report <br />is provided, and visual analysis of the proposed structure's location is provided . <br />ROLL CALL VOTE <br />AYES: Commissioners Maas and Chairperson Kumazan <br />NOES: Commissioners Cooper, Roberts and Sullivan <br />ABSENT: None <br />ABSTAIN: None <br />The motion failed on a 3-2 vote. <br />There was considerable discussion relating to additional poles being installed on the property to define <br />the view line and structure height, the Foothill Road Overlay Guidelines, additional geotechnical <br />surveys being conducted when the structure is approved for the building, and timeline for completion of <br />review of Foothill Overlay guidelines. <br />PLANNING COMMISSION MINUTES Page 9 October 14, 1998 <br />
