annexation of the property to the City. In conclusion, he stated that staffs recommendation is to adopt a <br />resolution recommending approval of the attached draft Negative Declaration to the City Council; make <br />the PUD findings as listed in the staff report, recommend that the project be considered as a first-come, <br />first-served project for purposes of growth management allocations as recommended by staff; <br />recommend approval of the project subject to the conditions as listed in Exhibit "B," or as modified to <br />address the above items for discussion. <br />Discussion ensued between Commissioners and staff relating to location of transplanted trees, <br />calculations available to measure noise impact on residents, the possibility of annexing property where <br />the manufacturing operations take place, public bus service on Foothill Road, the possibility of inserting <br />bus stops along Foothill Road for future public transportation, future projected traffic levels on <br />Muirwood, the number of heritage trees to be removed due to development of project, the schools where <br />enrollment levels will increase, single-story homes being built on Lot 39, the material being used for <br />fencing on Foothill Boulevazd, and removal of contaminants from soil at manufacturing plant. <br />Jim Summers, DeSilva Group, 11555 Dublin Blvd., Dublin, expressed appreciation to staff for their <br />cooperation. Further, he addressed issues from the July 22, 1998 meeting and stated that an additional <br />EVA has been developed at Prairie Drive, there will be all single-family homes on the perimeter of the <br />project, custom-lot design guidelines address the placement of houses, and additional attention will be <br />given to installing a signal at South Muirwood and Foothill Drive with a "no right turn on red <br />designation". <br />Mr. Summers addressed the site plan changes that have been made including a decrease in the number of <br />lots, acceptable noise levels being reached, modifications in placement of front and rear yards and the <br />type of windows being used, buffer zones, masonry wall being installed along the parameter of project, <br />and the EVA located at Prairie Drive. Further, he noted the applicant's efforts in addressing the <br />neighbor's concerns. <br />Jim Merritt, property owner, requested that the Commission grant a conditional use permit for the <br />manufacturing business extending for five years with the business satisfying all conditions required by <br />governmental agencies. Further, he stated that the business has been in operation for 23 years and a <br />complaint has never been filed, and that significant funds were spent bringing the building into <br />compliance with codes. <br />In response to an inquiry from Commissioner Cooper relating to the amount of money that would be <br />required to bring the building into compliance, Mr. Merritt responded that he would relocate the <br />building's operations to the metal building with the present barn building not being part of the <br />manufacturing operation. <br />Discussion ensued relating to the measures that need to be taken to bring the manufacturing business <br />into compliance with regulations, removal of the point source of contaminated soil, and relocation of the <br />existing home on property. <br />Glen Straw, 3928 Fernwood Way, requested that the Commission apply the same condition for a <br />single-story home on lot 38 as is being applied to lot 39.
