Commissioner Roberts stated she would be in support of approving the application as long as the <br />__ applicant keeps the doors to building shut. She expressed approval with the business being located in a <br />business park and being located away from residences. She concluded by stating that she would vote in <br />support of approving the application. <br />Commissioner Cooper stated he would be in support of approving the application and stated that in his <br />opinion the air quality is adequate and if future problems develop, that can be addressed at that time. He <br />concluded by stating he would vote in support of approving the application. <br />Commissioner Maas stated she would vote in support of approving the application. <br />Commissioner Sullivan expressed concern with the dischazge from the spray booths and stated that if <br />any problems occur with air quality, it can be addressed at that time. He concluded by stating that he <br />would vote in support of approving the application. <br />Chairperson Kumazan stated that this business appears not to pose a threat to the public's health, safety <br />and welfaze, but requested that the applicant keep the door closed to the building. He concluded by <br />stating he would vote in support of approving the application. <br />A motion was made by Commissioner Roberts, seconded by Commissioner Cooper, that the <br />Commission make the required conditional use permit findings and approve Case UP-98-53, <br />subject to the conditions listed in Exhibit "B". <br />- ROLL CALL VOTE <br />AYES: Commissioners Cooper, Maas, Roberts, Sullivan, and Chairperson Kumazan <br />NOES: None <br />ABSENT: None <br />ABSTAIN: None <br />Resolution No. PC-98-72 was entered and adopted as motioned. <br />b. PUD-96-14, Merritt/Scholes (DeSilva/Gatesl <br />Application for Planned Unit Development prezoning and development plan approval for <br />91-single family (including three existing homes) on 46.4 acres located at 4131 and 4141 <br />Foothill Road. Alameda County's zoning for the property is A (Agricultural) District. The <br />Planning Commission will also consider the Negative Declaration prepared for the project. <br />Mr. Iserson referenced a staff report dated September 23, 1998 and provided an overview of the July 22, <br />1998, heazing. He highlighted key areas contained in the staff report including background, project <br />description, density and public amenity, traffic and circulation, emergency vehicle access (EVA), lots 16 <br />and 17, lots 89 and 90, Foothill Road Improvements, tree planting, location of single-family homes, and <br />growth management.
