Commissioner Dove indicated he will amend his original motion to include staff s <br />recommendations of not including a traffic light at this point, but when the traffic light is <br />required, the applicant will be responsible for bearing the cost of installation of traffic light when <br />determined by the city traffic engineer to be necessary. There was a second by Commissioner <br />Roberts to include the amendment to motion. <br />Commissioner Sullivan stated he would like to support approval of the application, but was concerned <br />with the ability of the Planning Commission in enforcing a TSM program afrer the application is <br />approved. Further, he reiterated his desire to negotiate a TSM program before application is approved. <br />Commissioner Maas sought clarification from Commissioner Sullivan relating to whether he is <br />establishing a precedent and will not approve any applications until an agreeable alternative is reached <br />relating to traffic issues. Commissioner Sullivan responded that no further applications should be <br />approved until traffic issues aze addressed. <br />Discussion ensued relating to alternatives available to mandate TSM programs. <br />The motion was clarified by Commissioner Dove and seconded by Commissioner Roberts, that the <br />Planning Commission adopt a resolution approving Case No. Z- 98-104 subject to the draft <br />conditions as contained in Exhibit "B," adding a condition that the applicant be required to <br />provide amutually-agreed upon TSM plan for review by the Planning Commission within six <br />months of the project's approval and prior to the applicant assuming occupancy in the new <br />facility, and adding a condition that a traffic signal be installed at the intersection of Owens Drive <br />and Andrews Drive when it is determined to be necessary by the City's Traffic Engineer. <br />ROLL CALL VOTE <br />AYES: Commissioners Dove, Maas, Roberts, Sullivan, and Chairperson Kumaran <br />NOES: None <br />ABSENT: Commissioner Cooper <br />ABSTAIN: None <br />Resolution No. PC-98-66 was entered and adopted as motioned. <br />(Recess taken from 8:55 p.m. to 9:00 p.m.) <br />c. INC./HACIENDA MARKETING <br />Application for PUD design review approval to allow the construction of amaster-planned <br />office development consisting of seven buildings totaling 999,702+ square feet and two <br />parking garages on four parcels of land totaling 38.25+ acres located at 5900, 5801, 5830 <br />and 5844 Owens Drive in the Hacienda Park (Site 56, 57A, 57B, and 57C). As part of the <br />master planned development, the Owens Drive driveway and a portion of rear parking lot <br />of the existing PeopleSoft office building would be modified to create an integrated <br />automobile and pedestrian circulation system with the proposed development.
