A motion was made by Commissioner Kumaran, seconded by Commissioner Sullivan, that <br />recommendation be submitted to the City Council for temporary closure of Harvest Road until a <br />study can be undertaken and data received by a citizen's committee consisting of residents, church <br />and high school, for permanent traffic solutions in the Harvest Road neighborhood. <br />ROLL CALL VOTE <br />AYES; Commissioners Kumaran, Sullivan, and Chairperson Cooper <br />NOES: Commissioner Dove <br />ABSENT: Commissioners Maas and Roberts <br />ABSTAIN: None <br />Resolution No. PC-98-61 was entered as motioned. <br />Commissioner Dove noted for the record that he voted "no" due to the appropriate recommendation to <br />the City Council being a request for a traffic study to be conducted. <br />c. PUD-97-14/UP-97-70 Chevron <br />Application for a Planned Unit Development rezoning and development plan approval and <br />for a conditional use permit to allow the construction and operation of a 24-hour self-service <br />gasoline station and convenience store with the sale of alcohol beverages located at 1797 Santa <br />Rita Road. Zoning for the property is CN (Neighborhood Commercial District. Also consider the <br />negative declaration prepared for the project. <br />Marion Pavan, Associate Planner, referenced the staff report dated July 29, 1998, relating to the Chevron <br />Products Company, Inc., and highlighted key areas contained in the report including background, project <br />description, traffic, land use, lighting, alcoholic beverage sales, site and building design, landscaping and <br />signs. <br />PUBLIC HEARING WAS OPENED <br />Gary Ward, consultant to Chevron Products Company, Inc., noted that the adjacent Amador Shopping <br />Center has recently been redeveloped with the exception of the Chevron Station location and this project <br />will complete that redevelopment. Further, Mr. Ward expressed concurrence with the staff report and <br />recommendations. <br />Ronald L. Berkheiser, 1893 Cortez Court, expressed concern with noise levels, improper use of parking <br />lot for tour buses, and sale of alcoholic beverages. Further, he expressed support with Chevron's station <br />being an amenity to the community and for approval of application; however, he stated he does not <br />concur with the alcohol sales being conducted in that location. In conclusion, he requested that staff <br />address issues relating to improper use of parking lot. <br />Pamela Alpert, 1847 Harms Drive, expressed appreciation to the staff for their help, and spoke in <br />support of the proposed improvement of site.
