_ Chair Cooper informed Mr. Harding that he could call the City to inspect the site for dust control. He <br />also asked Mr. Harding if he wanted to see the project completed. Mr. Hazding replied thhat he wants to <br />see the original conditions implemented. He added that the applicant should follow the conditions from <br />the outset and that he should not have to call the City to have them adhered to. <br />Ms. Angela Harding, 3804 Stone Pointe Way, stated that she did not want to exchangz her Saturdays <br />during three months this summer for two weeks without construction. She pointed out',that they have <br />tried to be good neighbors and have not complained about not being able to open their windows because <br />of the noise and dust, about how the house shakes because of the equipment, about work',, starting before <br />8:00 a.m., and even about rodents. She added that indoor construction will not keep the noise out <br />because there would be power tools, hammers, and open windows. She requested the commission to <br />give this matter a serious consideration and deny the application. <br />Mr. Pat Calhoun, 3629 Huff Court, stated that the project is by his backyard. He pointed out that two <br />weeks for the applicant is three months for him which he can spend with his family outside but would <br />not be able to do because there would be too much noise. <br />Dr. Bernstein stated that he has tried to work things out with the neighbors as much aS he could, but <br />there aze things that are beyond his control in this business, such as contractors starting ~NOrk eazly. He <br />asked the Commission to consider his application. <br />Commissioner Roberts inquired why work on the site began only in February 1998.'. Dr. Bernstein <br />replied that it took that long to get the building plans through the process and it did not make sense to <br />start construction in November. <br />In connection with Dr. Bernstein's comment that construction days were not an issue,', Commissioner <br />Maas noted that the staff report indicates there were concerns about traffic and noise; and the City <br />Council restricted the project to the Monday-through-Friday work days. Dr. Bernstein stated that that <br />was an error. Mr. Iserson clarified that the City Council approved the project with the conditions that <br />staff had proposed. He explained that the majority of the these concerns were expressed to staff directly <br />during the review process prior to the hearings and that the Planning Commission and City Council <br />hearings dealt mostly with the project itself and traffic. <br />PUBLIC HEARING WAS CLOSED <br />Commissioner Maas inquired about the possibility of using portables. Mr. Iserson replied that this <br />would require another set of hearings. <br />Commissioner Maas stated that she did not think it was fair to penalize the neighbors who are going <br />through everything else with additional construction on Saturday. She indicated that she would agree <br />with staff and deny the application, <br />Commissioner Kumaran indicated that he sympathizes with Dr. Bernstein and his concerns. He stated, <br />_. however, that he did not feel comfortable about changing the original conditions and would agree with <br />staff to restrict the hours and deny the request. <br />Planning Commission Minutes Page 17 June 24, 1998 <br />
