Commissioner Roberts stated that the neighbors have a good point in wanting their Saturdays during the
summer. She indicated that she would have to agree with staffs recommendation not to allow work on
Saturday.
Commissioner Sullivan indicated that he would also support staffs recommendation. He stated that
developers need to live up to commitments they make to the neighbors because these projects have a big
impact on the neighbors' quality of life.
Chair Cooper stated that, in general, he would not want to see construction anywhere near residential
units permitted on Saturdays. He indicated, however, that he would like to see the project completed
and, therefore, would like to allow Saturday indoor construction on condition that the walls and
windows are up and the windows remain closed, similar to the conditions imposed on the St. Elizabeth
Seton church.
Commissioner Sullivan commented that one of the neighbors mentioned that her house is so close to the
project that indoor construction can still be heard. Commissioner Maas expressed concern that the
condition to close the windows may not be adhered to, considering that some of the original conditions
have not been followed.
A motion was made by Commissioner Roberts, seconded by Commissioner Sullivan, to deny
- Case PUD-96-19-1M.
ROLL CALL VOTE:
AYES: Commissioners Kumaran, Maas, Roberts, and Sullivan
NOES: Chair Cooper
ABSENT: None
ABSTAIN: None
Resolution No. PC-98-47 was entered and adopted as motioned.
Mr. Iserson indicated that the applicant has 15 days to appeal the Commission's decision to the City
Council.
d. PUD-97-12, New Cities Development Grouu
Application for PUD development plan approval for 62 single-family residential lots on an
approximately 34.7-acre site located south of the terminus of Independence Drive in the North
Sycamore area. Zoning for the property is PUD (Planned Unit Development) - LDR (Low Density
Residential) District.
Ms. Linda Butler, 1141 Lund Ranch Road, a concerned and interested neighbor, stated that most of the
__ neighbors have had to go home because of the late hour. She requested that the Commission refrain
from giving direction to the applicant this evening and wait until it hears the concerns and opinions of
the neighbors.
Planning Commission Minutes Page 18 June 24, 1998
