RECESS TAKEN AT 9:40 P.M. <br />RECONVENED AT 9:45 P.M. <br />c. PUD-96-19-1M, Early Learning Institute <br />Application for a modification to an approved Planned Unit Development for a private school to <br />modify the conditions of approval of Case PUD-96-19 to allow site and building construction from <br />8:00 a.m. to 5:00 p.m., Monday through Saturday, for the property located at 3800 Skoneridge <br />Drive. Zoning for the property is PUD (Planned Unit Development) - P/I (Public and <br />Institutional) District. <br />Mr. Iserson presented the staff report and the stated that this project was approved a yeaz ago for a <br />private school for 200 students. He noted that during that public heazing, there was significant <br />neighborhood opposition to the project regazding traffic, access, pazking, building height, and having a <br />commercial-type use in a residential neighborhood. Concerns were also raised with respect to noise and <br />construction hours, and as a mitigation to these concerns, a condition was added to limit construction <br />hours to Monday through Friday from 8:00 a.m. to 5:00 p.m. Mr. Iserson pointed out that the standard <br />condition for construction hours is Monday through Saturday, from 8:00 a.m. to 5:00 p.m. <br />Mr. Iserson continued that the applicant is now requesting that the construction hours be extended to <br />include Saturdays, citing that the unusual winter weather has imposed a significant delay to the project, <br />thus making it impossible to open the school in September as planned. Also, speeding up the <br />- construction would complete the project sooner and benefit the neighborhood in the L sense that the <br />contractors and the associated impacts would leave the area sooner. Mr. Iserson expaained that the <br />application was initially treated as a minor modification, but due to the significant number of concerns <br />from the neighbors, the application is being handled as a major modification and would have to come <br />before the City Council for approval. Mr. Iserson continued that there aze several development projects <br />undergoing construction activities in the general azea of Stoneridge Drive. Because many neighbors aze <br />sensitive to Saturday construction hours and would like to spend their Saturdays relaxing at home <br />outdoors, free from construction, noise, and traffic, staff is proposing to abide by the original conditions <br />and recommends that the Commission deny the application. <br />Commissioner Roberts inquired if the construction hours of the other development projects in the area <br />aze limited to Monday through Friday. Mr. Iserson said no; they have Saturday constructvon hours. <br />Chair Cooper inquired if St. Elizabeth Seton Church was conditioned to limit Saturday activities to <br />indoor construction. Mr. Iserson replied that he could not recall <br />Commissioner Roberts inquired if the applicant had another facility in Hacienda Business Park. <br />Mr. Iserson said yes. Commissioner Roberts commented that the delay in opening the school would, <br />therefore, not necessarily delay their operation since they have another place.
