Resolution No. PC-98-45 was entered and adopted finding that the project would not have a <br />significant effect on the environment and recommending approval of the draft Negative <br />Declaration for Case PUD-98-04 and finding that the project has a De Minimis impact on the site's <br />wildlife. <br />A motion was made by Commissioner Kumaran, seconded by Commissioner Maas, do recommend <br />that the proposed PUD development plan is consistent with the General Plan and purposes of the <br />PUD ordinance. <br />ROLL CALL VOTE: <br />AYES: Commissioners Kumaran, Maas, Roberts, and Chair Cooper <br />NOES: Commissioner Sullivan <br />ABSENT: None <br />ABSTAIN: None <br />Commissioner Sullivan noted for the record that he voted "no" because he did not believe,the General <br />Plan encourages what is essentially a residential facility to be built with border-line noise levels. <br />A motion was made by Commissioner Maas, seconded by Commissioner Roberts, to'recommend <br />approval of Case PUD-98-04 subject to the conditions in Exhibit B with the followin~ <br />modifications: <br />- 1) Delete Condition No. 8 which refers to the installation of a deceleration lame; <br />2) Widen the Santa Rita Road driveway to provide easier turning access; <br />3) Include stronger language giving priority to Pleasanton residents and then immediate <br />family to avail of the affordable units; and <br />4) Include stronger language that the affordable housing program would remain in <br />perpetuity and that the City would be able to recoup its funds should the program be <br />terminated. <br />ROLL CALL VOTE: <br />AYES: Commissioners Kumaran, Maas, Roberts, and Chair Cooper <br />NOES: Commissioner Sullivan <br />ABSENT: None <br />ABSTAIN: None <br />Commissioner Sullivan noted for the record that he voted no for the same reason. <br />Resolution No. PC-98-46 was entered and adopted recommending that the proposed PUD <br />development plan is consistent with the General Plan and purposes of the PUD ordinance, and <br />recommending approval of Case PUD-98-04 as motioned. <br />Planning Commission Minutes Page 14 June 24, 1998 <br />
