Mr. Iserson gave a history of the application and described the proposed sites located within the Oak <br />_. Tree Farm development. He noted that the applicant has already received design review approval for <br />the two homes which are currently under construction, but would like to offer the secondary units as <br />an option to potential buyers. If the buyer chooses not to include the secondary unit in the purchase, <br />the additional floor area would be used solely as a bedroom or a bonus room with no kitchen facilities. <br />Mr. Iserson explained the state law relating to secondary units, noting that the units could be used for <br />family members, as guest quarters, or as rental units. He also noted that the City is in the process of <br />drafting an ordinance which would allow uncontested secondary use permit applications to be <br />approved at the staff level. <br />Mr. Iserson reported that the proposed secondary units would be virtually identical. Each unit would <br />take up approximately 9.5% of the floor area of the entire home and would be integrated into and <br />accessible from the main home. Each unit would consist of a combined bedroom/living area with <br />kitchen facilities, walk-in closet, bathroom, and a separate access leading to a small patio area in the <br />rear yard. In addition, each unit would have its own designated resident and guest parking spaces <br />and, therefore, all parking requirements have been satisfied. <br />Mr. Iserson stated that since the size of the unit is limited, staff feels that the number of people who <br />could comfortably reside in the unit is also limited. A condition of approval has been included to limit <br />the number of residents in each unit. Also, because of the recommended limit of occupants, staff feels <br />that the traffic generated by residents of the units would not be greater, and would actually probably <br />_ be less than that of a typical single-family residence. In addition, Mr. Iserson reported that notices <br />were sent to all property owners within 300 feet of the subject properties and, as of today, no <br />comments have been received. <br />Mr. Iserson also pointed out that the requirements of the state law relating to secondary units are <br />outlined in the staff report. He explained the requirements in detail and how this application complies <br />with each. <br />In conclusion, Mr. Iserson stated that staff is in support of the application, subject to the separate <br />conditions of approval for each respective residence. <br />In response to a question by Commissioner Roberts, Mr. Iserson explained the criteria which <br />constitutes a secondary unit. <br />Commissioner Sullivan asked for more detailed information relating to the proposed ordinance being <br />drafted. Mr. Iserson explained that depending on how the ordinance is approved, staff would be able <br />to grant secondary use permit applications at the staff level in cases where all conditions have been <br />met and there is no opposition to the application. <br />Commissioner Sullivan also asked whether there are currently any other secondary units in the Oak <br />Tree Farm Development and whether a traffic impact study had been done for the entire development <br />at the time of approval.
