UP-97-103, Nigel Peck
Application for conditional use permit approval for a secondary unit in an approximately 650
square foot, 15-foot tall pool cabana structure located at 1505 Elderberry Court. Zoning for the
property is PUD (Planned Unit Development) - LDR (Low Density Residential) District.
Jerry Iserson gave a history of the application noting that the applicant has received previous design
review approval for a home and a cabana which are under construction at the site. Since the cabana
included a full kitchen, design review approval was granted contingent upon use permit approval for the
secondary unit. Mr. Iserson stated that the applicant intends to use the cabana for entertainment and
convenience purposes only, although it could be used as a secondary unit in the future.
Mr. Iserson further reported that the cabana will be made of stucco and will be similaz in color to match
the home. Staff feels that it is compatible as a detached secondary unit, although there is no plan at the
moment to use it as such. Additionally, staff has not identified any impacts with the cabana and there
have been no concerns expressed by neighbors. Staff is, therefore, recommending approval, subject to
the conditions in Exhibit B.
PUBLIC HEARING WAS OPENED
Nigel Peck, 1505 Elderberry Court, Pleasanton, stated that he is in agreement with the staff report and
staff s condition. He confirmed that the intent of the cabana is for entertainment and convenience
purposes and that there are no plans to use it as a secondary unit at this time.
