Commissioner Dove stated that he understands Commissioner Wright's point; however, he also agrees <br />with Commissioners Barker and Kumazan. He believes that a restaurant would generate much more <br />traffic. He also expressed his support of this application. <br />Chair Cooper commented that the architectural design is nice and feels a furniture store will create less <br />traffic than most other businesses. He further stated that the comer location will provide more customer <br />exposure for the business. In addition, he agrees with the azchitect that the dazk color should remain at a <br />lower level. He is also in support of the application. <br />A motion was made by Commissioner Barker, seconded by Commissiouer Kumaran, <br />recommending approval of PUD-96-13-1D, subject to the conditions in Exhibit "B," except to <br />modify condition 9 to read that prior to the issuance of building permits, the elevation shall be <br />modified 6y providing architectural reveals on the base to create a difference between the two <br />colors. <br />ROLL CALL VOTE <br />AYES: Commissioners Bazker, Dove, and Kumaran, and Chair Cooper <br />NOES: Commissioner Wright <br />ABSENT: None <br />ABSTAIN: None <br />_ Resolution No. PC 98-07 was entered and adopted as motioned. <br />7. MATTERS INITIATED BY COMMISSION MEMBERS <br />Commissioner Dove suggested, and Commissioner Wright agreed, that if it's proper and the City <br />Attomey will permit it, approval of secondary units should not be required to come before the <br />Commission unless there is opposition voiced from neighbors. He feels this is an application that can be <br />approved by staff. Mr. Iserson responded that although it could be possible, the Code would need to be <br />amended to make secondary units permitted uses. Lazissa Seto, Assistant City Attorney, stated that <br />although she does not believe they could be made permitted uses, she feels that the Commission could <br />delegate their authority to approve them as conditionally permitted uses to the Planning Staff. However, <br />in the event that staff determines that it might be controversial or if the application is opposed, it could <br />come before the Commission. Ms. Seto stated that the most important thing is to make sure that <br />appropriate conditions are placed on applications and if it were changed to a permitted use, conditions <br />may not be able to be placed. A brief discussion took place regazding secondary units and conditional <br />use permits. Mr. Iserson agreed to put the issue on his work calendar and address it with staff as soon as <br />possible. <br />Commissioner Dove commented that there are four or five homes on First Street, north of Neal, that <br />have been substantially improved and they enhance the appearance of the neighborhood. He suggested <br />that the City send the homeowners a letter commending them for improving their property and <br />- beautifying the neighborhood. He offered to obtain the addresses and draft a letter for the Commission's <br />review. <br />Planning Commission Page 10 January 28, 1998 <br />
