to place assessments on the tax rolls for properties within the CSA in accordance <br />with County Service Area Law in amounts sufficient to raise revenue to meet all <br />payments outstanding and for payments anticipated to become due in that fiscal <br />year, including those for which County has received notice from the City that any <br />of the payments described herein are anticipated to become due. In no case will <br />payment of costs shall be made later than two (2) years after its due date. <br /> <br /> 5. Interest. Interest shall accrue and be payable at a rate of ten <br /> <br />percent (10%) per year from the time any of the payments included herein become due <br /> <br />until the time of payment. <br /> <br /> 6. Operation and Maintenance of New Sewer Connection. County will <br /> <br />contract for operation and maintenance services, for the new sewer facilities <br />between the existing Castlewood collection system and the West Pleasanton Interceptor <br />Sewer System, as delineated in the April, 1984 Addendum Report by Lowry & Associates. <br /> <br /> 7. Operation and Maintenance of Old Castlewood Sewer Facilities. County <br /> <br />will contract for the operation, maintenance, testing and repair of the old <br />gravity collection sewer facilities within the CSA. City will be furnished within <br />two (2) years of the execution of this Agreement a plan for upgrading the old <br />gravity collection system. <br /> <br /> · 8. Time of Connection. Connection of 183 RDEs into the West Pleasanton <br />Interceptor Sewer or other sewerage facilities may be made at any time after <br />execution of this Agreement. City reserves the right to limit sewage flow from the <br />CSA to the remaining 125 RDE connections until the 4.38 MGD LAVWMA expansion <br />contract has been let. <br /> <br /> 9. City Review of CSA Annexations. City reserves the right to review <br /> <br />future annexations to the CSA and to withhold sewerage service to any annexation in <br />the event the City determines (i) that such area proposed for annexation lies <br />outside the boundaries of the assessment district which installed the West Pleasanton <br />Interceptor Sewer and (ii) that there is insufficient capacity in the West Pleasanton <br />Interceptor Sewer for the area proposed to be annexed. <br /> <br /> 10. Revenue Program. City shall maintain a revenue program in accordance <br /> <br />with EPA and SWRCB requirements and notify County of the amount of the fees and <br />charges to be assessed to County pursuant to this Agreement.
