23. Prior to issuance of a building permit, the applicant shall enter into an agreement <br />with the City to pay its pro-rata share of the installation of an additional <br />westbound through lane on Stoneridge Drive at the intersection of Johnson Drive <br />at Stoneridge Drive. <br />24. Prior to issuance of a building permit, the applicant shall pay its pro-rata share for <br />the installation of a traffic signal at Stoneridge Mall Road at Embarcadero Court. <br />25. Prior to issuance of a building permit, the applicant shall pay its pro-rata share of <br />the remaining traffic improvements stated in the "Restated and Amended <br />Reimbursement Agreement for Stoneridge Corporate Plaza II." Prior to issuance <br />of a building permit, the remaining traffic improvement at Stoneridge Drive at <br />Stoneridge Mall Road shall be designed by the applicant. To the extent such <br />design costs exceed the applicant's pro-rata share for the overall traffic <br />improvement (design, right-of-way costs, and construction), it will be reimbursed; <br />to the extent such costs are less than the applicant's pro-rata share, the applicant <br />shall pay the difference once those final costs are known. <br />26. The traffic fees and applicant's pro-rata share of the traffic mitigations for this <br />project may take into account trip reductions due to internally captured trips, <br />transit reductions, and pass-by trips, subject to the final approval by the City <br />Traffic Engineer. <br />27. The entrance/exit drive into the development from Stoneridge Mall Road may <br />need to be modified to accommodate traffic movements. The applicant shall <br />work with the Stoneridge Corporate Plaza owner to effectuate any driveway <br />modifications on the Stoneridge Corporate Plaza property. The lane widths and <br />length shall be submitted for the review and approval of the City Engineer and <br />Director of Planning and Community Development. If the driveway needs to be <br />modified, the Director of Planning and Community Development may approve the <br />modification without a PUD modification. <br />28. The applicant shall install a pedestrian crossing in Stoneridge Mall Road between <br />the mall property and the BART station property near the BART driveway should <br />this project develop before the Stoneridge Mall expansion. The project developer <br />shall consult with representatives of BART and Stoneridge Mall in developing the <br />design for the pedestrian crossing. Traffic controls for the crossing (e.g., flashing <br />beacons, a raised median, advanced signing and pavement marking, in <br />pavement flashers, etc.), shall be worked out to the satisfaction of the Director of <br />Planning and Community Development and the City Engineer at the crossing's <br />design stage. The pedestrian crossing shall be installed to the satisfaction of the <br />City Engineer. If the applicant installs the crosswalk, it shall be eligible to enter <br />into a reimbursement agreement to recover some of the costs of the crosswalk <br />from the Mall. <br />4 <br />
