29. The applicant shall coordinate with the City to provide and finish the area <br />reserved for "Police Station" use next to the retail area by the City of Pleasanton <br />Police Department and the BART Police Department. The area shall be <br />reserved for sole use by the City and BART Police and an agreement or <br />agreements shall be developed and executed prior to the first building permit <br />issuance. The agreement shall determine to what leasing agreements, costs, <br />length of time for occupancy, level the interior shall be completed, the <br />furnishings, communications, parking, etc. that shall be provided for by the <br />development for such use. The applicant and/or future owner shall be provided <br />with assurances that if such use were to be vacated, the agreements on file <br />would be modified or otherwise able to be converted to additional retail space. <br />30. Prior to issuance of a building permit, the developer shall have a health risk <br />assessment completed by a qualified air quality consultant to determine if the <br />residential units within 500 feet of the closest travel lane of I-580 would be <br />significantly exposed to diesel particulate matter. A copy of the health risk <br />assessment shall be provided to the Director of Planning and Community <br />Development. If necessary, the health risk assessment shall make <br />recommendations for reducing diesel particulate matter exposure to on-site <br />residents to acceptable levels as established by BAAQMD (e.g., modifying the <br />location or height of intakes to the ventilation system or the addition of HEPA air <br />filtration systems). Details of any recommendations shall be submitted in <br />conjunction with the plans submitted for issuance of building permits and shall be <br />subject to the review and approval by the Director of Planning and Community <br />Development prior to issuance of building permits for the project. The applicant's <br />air quality consultant shall review the applicable air quality mitigations shown on <br />the building permit plans to ensure that the recommendations have been properly <br />incorporated into the design. The consultant shall certify in writing that such <br />recommendations have been followed. <br />31. The developer shall comply with the recommendations of the noise study entitled <br />"BART Mixed-Use -Pleasanton Apartments Results of Environmental Noise <br />Study' by Charles M. Salter Associates, Inc., dated July 6, 2007. Details of the <br />noise mitigations shall be submitted in conjunction with the plans submitted for <br />issuance of building permits and shall be subject to the review and approval by <br />the Director of Planning and Community Development prior to issuance of <br />building permits for the project. The applicant's noise consultant shall review the <br />applicable noise mitigations shown on the building permit plans to ensure that the <br />recommendations have been properly incorporated into the design. The <br />consultant shall certify in writing that such recommendations have been followed. <br />32. The developer shall include within the apartment project design a fully screened <br />location for a future satellite dish antenna satisfactory to the Director of Planning <br />and Community Development or shall provide underground cable facilities to <br />serve all users of the site.
