Use of this water line shall be on an interim basis and shall be <br />discontinued at such time as the Brozosky property is connected to the City <br />water system under the Vineyard Avenue Corridor Specific Plan. This condition <br />may also be satisfied by a separate agreement signed by the Chrismans/ <br />Brozoskys." <br />The Planning Commission was presented with the following three options with respect <br />to Condition of Approval No. 23 of the Tentative Vesting Map 7399, for consideration <br />and subsequent recommendation to the City Council: <br />Option 1: Affirm Condition No. 23, unchanged. <br />Option 2: Revise Condition No. 23 by adding the following: <br />Provide a permanent meter at the northeast corner within the public <br />right-of-way; <br />• Require the Chrismans to finance the construction of a temporary <br />water line along the easterly property line within the Brozosky property; <br />and <br />• Allow the Chrismans continued use of the joint well. <br />Option 3: Rescind Condition No. 23 and not require the Chrismans to provide <br />temporary water service to the Brozosky property. <br />In addition, the Planning Commission was informed by staff that repealing long-term use <br />of the joint well by the Chrismans, as condition of development, was an option. <br />The Planning Commission discussed the three options and determined that it supported <br />Option 2, upholding the intent of the condition crafted by the City Council, with additional <br />modifications to set timing requirements for the completion of the work on the Brozosky <br />property, as follows: <br />• Provide a permanent meter at the northeast corner within the public right-of-way. <br />The Chrismans shall finance the construction of a temporary water line along the <br />easterly Chrisman property line within the Brozosky property (westerly Brozosky <br />property line) <br />^ The Chrismans shall provide the Brozoskys notice of the Chrismans' intent <br />to proceed within aone-year period from the date of the final map <br />recordation; <br />^ Three bids shall be submitted to the City. The City shall facilitate the <br />choice of the contractor providing copies of the bids to both the Chrismans <br />and the Brozoskys. Bids shall be submitted 60 days before the grading <br />permit is used. <br />Page 7 of 12 <br />
