^ The Chrismans shall deposit 200 percent of the lowest bid to an escrow <br />account to construct the water line. <br />^ The water line shall be constructed from the permanent meter at the <br />northeast corner of the Chrisman development within the existing public <br />right-of-way. <br />^ The temporary water line shall be brought to an existing water line on the <br />Brozosky property before the first building permit is issued. <br />^ If the actual cost of the water line exceeds the accepted bid, the <br />Chrismans shall be responsible for paying the increase in costs. <br />• Allow the Chrismans continued use of the joint well. <br />This condition may also by satisfied by a separate agreement signed by the <br />Chrismans/Brozoskys. <br />Staff supports the Planning Commission's amendments to the Conditions of Approval. <br />Design Review Process <br />The Planning Commission considered staffs recommendation to allow the custom <br />homes to be reviewed at the Zoning Administrator level, creating a similar process with <br />a 20-day appeal period, as other projects such as Mariposa Ranch at Callippe Preserve <br />Golf Course have instituted. There was concern by the Planning Commission that the <br />homes at this location warranted that the proposed homes be brought to the Planning <br />Commission for review and approval rather than through a Zoning Administrator review <br />process. Staff believes that the homes would be similar to the Berlogars' Silver Oaks <br />Estates. The Berlogar Phase I has a Zoning Administrator review process as described <br />above. Staff recommends that the City Council allow the Phase II development the <br />same review process that is in place for Phase I, which is memorialized in the Silver <br />Oaks Estates Design Guidelines. <br />Please refer to the Planning Commission staff report, dated February 27, 2008, for <br />additional information. <br />PUD DEVELOPMENT PLAN FINDINGS <br />Please refer to the PUD findings listed in Attachment 3. <br />PUBLIC NOTICE <br />Notices of the City Council's public hearing on this item were sent to the homeowners <br />located in the Ruby Hill development and within 1,000-feet of the subject property. Staff <br />has not received any comments pertaining to the proposed project as of the time the <br />staff report was written. <br />ENVIRONMENTAL ASSESSMENT <br />Environmental review for the proposed project was undertaken with the Final <br />Environmental Impact Report (EIR) approved by the City Council for the Vineyard <br />Avenue Corridor Specific Plan in conformance with the standards of the California <br />Page 8 of 12 <br />
