I. Pleasanton General Plan Amendments <br />Policy 12 Program 12 3 on paae II-17 of the City of Pleasanton Auaust 6 1996 General <br />Plan is added as shown: <br />Policy 12.3: Ridgelines and hillsides shall be protected. Housing units and structures <br />shall not be placed on slopes of 25 percent or greater, or within 100 vertical feet of a <br />ridgeline. No grading to construct residential or commercial structures shall occur on <br />hillside slopes 25% or greater, or within 100 vertical feet of a ridgeline. Exempt from this <br />policy are housing developments or 10 or fewer housing units on a single property that <br />was, as of January 1, 2007, "legal parcel" pursuant to the California Subdivision Map <br />law. Splitting, dividing, or sub-dividing a "legal parcel" of January 1, 2007 to approve <br />more than 10 housing units is not allowed. <br />Policy 15 on Paae II-19 of the Citv of Pleasanton Auaust 6, 1996 General Plan is added <br />as shown: <br />Policy 15.3: A housing unit is defined to include any residence that includes a kitchen <br />(sink, cooking device, and refrigerator) and a bathroom (toilet, tub or shower). The City <br />Council shall uphold the housing cap and shall not grant waivers that exclude housing <br />units consistent with this definition. <br />If any portions of this initiative are declared invalid by a court, the remaining <br />portions are to be considered valid. <br />III. The provisions of this initiative may be amended or repealed only by the voters of <br />the City of Pleasanton at a City general election and overrides any existing <br />General Plan. <br />Section 3. The City Clerk is directed to transmit the initiative measure to the City <br />Attorney to prepare an impartial analysis of the measure by Friday, August 8, 2008. <br />Section 4. Except as provided otherwise in this resolution, the City Council hereby <br />adopts the procedures set forth in California Elections Code §9285 regarding submission of <br />rebuttal arguments. <br />Section 5. The City Council hereby establishes Friday, August 15, 2008 and Friday, <br />August 22, 2008, respectively, as the deadlines for submission of direct arguments and rebuttal <br />arguments for the initiative measure. These arguments must be submitted to the City Clerk by <br />5:00 p.m. on the respective deadline dates. <br />Section 6. The City Council authorizes Council member Cook-Kallio to write a direct <br />argument against the initiative measure, and a rebuttal to the direct argument in favor of the <br />initiative measure, and gives preference and priority to such arguments pursuant to Elections <br />Code §9287(a); and delegates to her the selection of other persons to sign such arguments. <br />Section 7. "that notice of the time and place of holding the election is given and the <br />City Clerk is authorized, instructed and directed to give further or additional notice of the <br />election, in time, form and manner as required by law. <br />
