Section 1. To furnish all labor, materials, tools, and equipment, <br />and to do all of the railroad work necessary to enable the City's <br />contractor to build the underpass. The work consists of modifying an <br />existing shoofly that was built to facilitate the construction of <br />Western Pacific underpasses at Del Valle Parkway, Bernal Avenue and <br />Sunol Road in Pleasanton. A shoofly approximately 1357 feet long will <br />be or has been constructed. 627 feet will be constructed by the <br />Western Pacific and 730 feet of shoofly will be constructed by the <br />Southern Pacific under the terms of this agreement. Other railroad <br />facilities will be relocated temporarily to a roadbed constructed (and <br />later removed) by the City and returned, upon completion of the under- <br />pass, to the bridge constructed by the City. Communication facilities <br />and a signal house will be relocated. A Material and Force Account <br />Estimate of cost made by the Western Pacific for Western Pacific work <br />is attached hereto, marked Exhibit B and made a part hereof. The <br />estimated cost of the Western Pacific work is $71,920.00. The details <br />of the Western Pacific work shown in the estimate will be controlling. <br />The Southern Pacific will also do work based on a Material and Force <br />Account Estimate that will be provided to the City before construction <br />begins. The Railroads will remove the shoofly track after the project <br />is complete. In addition, as part O~ the work on the project for <br />which the cost is not estimated, engineering inspection, roadway <br />watchmen service, flagging and other protective services and devices <br />will be provided by Railroads to protect their railroad facilities, <br />property and. operations. The actual cost of the work done by both <br />Railroads may be recovered as provided in Section 3 of this Article. <br /> <br /> 3 <br /> <br /> <br />
