Section 3. That the work of constructing the underpass will <br /> not begin until the City shall have given notice in writing to the <br /> Division Superintendents of the Western Pacific at Stockton, Cali- <br /> fornia, and the Southern Pacific at Oakland. The notices shall state <br /> the time that operations for the construction of the underpass shall <br /> begin. The construction of the underpass shall be performed and <br /> effected in such a manner as to interfere as little as possible with <br /> the safe and timely operation of locomotives, trains and cars of the <br /> Railroads over their tracks at the crossing. <br /> <br /> Section 4. Upon completion of construction, City, at its <br />expense, shall maintain those portions of said underpass structure <br />beneath the bridge seats or bearings, including piles, footings, <br />piers, abutments and bulkheads, and shall maintain all roadway <br />approaches, lighting, drainage, pumping installations, landscaping, <br />and any other street or highway facilities. Railroads, at their <br />expense, shall maintain Railroads' tracks, roadbed, railroad <br />drainage, those portions of the underpass structure above the <br />bottom surface of bridge bearings, and all other Railroad appurte- <br />nances. <br /> <br /> Section 5. That if Railroads;~hall deem it necessary or <br />desirable in the future, in the performance of their duties as <br />common carriers, to raise or lower the grade or change the alignment <br />of their tracks, or to lay additional track or tracks, or to build <br />other facilities in connection with the operation of the railroads, <br />they shall have full right to make such changes or additions. <br /> <br /> 15 <br /> <br /> <br />
