ARTICLE III <br /> <br /> The Railroads agree: <br /> <br /> Section 1. Western Pacific shall grant to Southern Pacific <br /> <br />an easement for the relocated tail track in accordance with the <br />terms and conditions in said Memorandum of Understanding. The <br />Railroads both shall have the right to use the tail track in <br />accordance with the terms analconditions in said Joint Track <br />Agreement. <br /> <br /> Section 2. The Railroads both have the right to use a <br /> <br />maintenance road located along the east and west legs of the <br />Southern Pacific wye track and across the proposed Valley Avenue <br />Roadway. <br /> <br /> ARTICLE IV <br /> <br /> The City and the Railroads agree: <br /> <br /> Section 1. That all work contemplated in this agreement <br />shall be performed in a good and workmanlike manner and to the <br />satisfaction of the parties hereto, and each portion shall be <br />promptly commenced by the parties hereto obligated to do the same, <br />and thereafter diligently prosecuted to conclusion in its logical <br />order and sequence. <br /> <br /> Section 2. That the underpass shall be constructed in <br />accordance with detailed plans approved by the parties, subject <br />to approval of the Public Utilities Commission of the State of <br />California, with minimum clearances as approved by the Public <br />Utilities Commission. <br /> <br /> 14 <br /> <br /> <br />
