Railroads hereinabove set forth in Section ll(a) and (b) <br /> of this Article II, and provided further, that if the work <br /> is performed by day labor employed by City, the City will, <br /> at its expense, provide for and on behalf of Railroads <br /> insurance in the amounts and form prescribed by Section <br /> ll(b) hereof. <br /> <br /> Section 12. The City agrees to furnish the Railroads with <br />permanent reproducible prints of all design and shop drawings as <br />soon as possible after final approval of drawings have been obtained. <br />Upon completion of construction, "as constructed" prints are to be <br />furnished the Railroads by City. If substantial changes are made, <br />revised "as constructed" reproducible prints with appropriate <br />information thereon are to be furnished to the Railroads. <br /> <br /> Section 13. The City agrees to proceed with the closure of <br />the private grade crossing at Mile Post 42.9, in the manner provided <br />in that certain agreement dated April 15, 1986, between City and <br />Kaiser Sand and Gravel Co. <br /> <br /> Section 14. The City agrees to release, defend, indemnify and <br />hold the Railroads harmless from any claims by users or occupiers or <br />any third persons for injuries or damages resulting from any 'negligent <br />design for portions designed by City, its agents, contractors or <br />subcontractors. Each party agrees to indemnify and hold the others <br />harmless from claims resulting from its own negligent construction or <br />maintenance of subject improvements. <br /> <br /> 13 <br /> <br /> <br />
