Gas Migration Mitigation Agreement <br /> September 5, 1986 <br /> Page 2 <br /> <br />to migrate from the LANDFILL onto OWNERS' PROPERTY in concen- <br />trations which are required to be mitigated under current <br />local, state and federal guidelines. <br /> <br /> 1.04 It is the intent of the parties that PGS shall <br /> <br />prevent the methane gas generated in the LANDFILL from <br />migrating across the boundary of the OWNERS' PROPERTY by the <br />installation of a boundary control system. It is further the <br />intent of the parties that PGS shall cause as much of the <br />methane gas that has migrated from the LANDFILL onto OWNERS' <br />PROPERTY to be removed as soon as possible, and the methane gas <br />be reduced to concentrations specified by local, State and <br />federal regulations as expeditiously as possible. <br /> <br /> 1.05 PGS, through its consultant, has made an <br /> <br />evaluation of the methane gas migration across the boundary of <br />the LANDFILL onto OWNERS' PROPERTY. <br /> <br /> 1.06 PGS's consultant has recommended installation <br /> <br />of a boundary control system in a report attached as Exhibit C <br />and incorporated by reference herein (hereafter referred to as <br />"CONSULTANT'S RECOMMENDATION"). <br /> <br /> 1.07 The consultant's estimate for the installation, <br /> <br />start-up, monitoring and operation of a boundary control system <br />as outlined in Exhibit C is $122,500.00 to $167,500.00. <br /> <br /> <br />
