Gas Migration Mitigation Agreement <br /> September 5, 1986 <br /> Page 3 <br /> <br /> 1.08 - It is the intent of PGS and OWNERS to enter <br />into this agreement to install and maintain the proposed <br />boundary control system, at no cost to the OWNERS, to prevent <br />further migration of methane gas onto OWNERS' PROPERTY and to <br />reduce any methane gas on OWNERS' PROPERTY originating in the <br />LANDFILL to concentrations specified by local, state and <br />federal regulations as expeditiously as possible and to remove <br />as much of the remaining methane gas as is reasonably possible. <br /> <br /> 1.09 Pursuant to Resolution 81-36 of the City <br /> <br />Council of the City of Pleasanton the costs to install and <br />maintain the boundary control system described herein are <br />recoverable costs out of future garbage rates which CITY <br />acknowledges by separate agreement. <br /> <br /> ARTICLE II <br /> <br /> DEFINITIONS <br /> <br /> The following terms shall be used as follows in this <br />Agreement: <br /> <br /> 2.01 PGS. Pleasanton Garbage Service, Inc. The <br /> <br />franchisee of the City of Pleasanton for collection and <br />disposal of municipal waste and owner of the LANDFILL. <br /> <br /> 2.02 CITY. City of Pleasanton. A general law city <br /> <br />of the State of California in Alameda County. <br /> <br /> <br />
