GAS. MIGRATION MITIGATION, AGREEMENT <br /> <br /> This Agreement is made and entered into this day <br /> <br />of , 1986, by and between PLEASANTON GARBAGE SERVICE, <br /> <br />INC., a California corporation (hereafter referred to as <br />"PGS"), and RALPH MARTIN and MARILYN E. LOGAN MOCIUN <br />(hereinafter referred to as "OWNERS"). PGS and OWNERS agree as <br />set forth below: <br /> <br /> ARTICLE I <br /> PURPOSE AND INTENT <br /> 1.01 PGS owns real property at 2512 Vineyard Avenue, <br /> <br />Alameda County, California, more specifically identified in <br />Exhibit A attached hereto and incorporated herein by <br />reference. Said real property was formerly used as a landfill <br />by PGS in connection with its franchise agreement to dispose of <br />municipal waste for CITY. (Said real property is hereafter <br />referred to as "LANDFILL"). <br /> <br /> 1.02 OWNERS own real property adjacent to landfill <br /> <br />at 2753 Crellin Road, Pleasanton, California, more specifically <br />identified in Exhibit B attached hereto and incorporated herein <br />by reference. (Said real property is hereafter referred to as <br />"OWNERS' PROPERTY"). <br /> <br /> 1.03 Methane gas is produced by the municipal waste <br /> <br />placed in the LANDFILL.
