Gas Migration Mitigation Agreement <br /> September 5, 1986 <br /> Page 7 <br /> <br /> ARTICLE V <br /> PERFORMANCE SCHEDULE <br /> 5.01 PGS shall install or cause to be installed the <br /> <br /> SYSTEM described in Exhibit C on the schedule attached as <br /> <br /> Exhibit D. <br /> <br /> 5.02 If the Standards of Performance required by <br /> <br />Article VI are not met, but no emergency situation is in <br />'existence, PGS shall comply with the following schedule: <br /> <br /> (a) Employ a consultant acceptable to the City to <br /> <br /> determine necessary additional measures within 30 <br /> days of discovery of violation. <br /> <br /> (b)Consultant to report to CITY, PGS and OWNER within <br /> <br /> 45 days of employment by PGS. <br /> <br /> (c) PGS shall undertake the additional mitigation <br /> measures recommended by the consultant in its report <br /> or required by the City within 30 days of delivery <br /> of the report to CITY. <br /> <br /> 5.03 If at any time the concentrations of methane <br /> <br /> gas on OWNERS' PROPERTY create a safety hazard to people or <br /> property, PGS shall immediately take whatever steps are <br /> necessary to eliminate the danger and then shall follow the <br /> provisions of Section 5.02. <br /> <br /> <br />
