Gas Migration Mitigation Agreement <br />September 5, 1986 <br />Page 8 <br /> <br /> ARTICLE VI <br /> PERFORMANCE STANDARDS <br /> 6.01 Methane gas levels shall not exceed the <br /> <br />strictest of the standards established by local, state or <br />federal governments or this Agreement on the LANDFILL or on <br />OWNERS' PROPERTY. <br /> <br /> 6.02 Methane gas levels shall not exceed concentra' <br /> <br />tions of 1.25 percent on any proposed building site on OWNER'S <br />PROPERTY as identified on the attached Exhibit E or any other <br />building site subsequently identified on OWNERS'PROPERTY, <br />provided PGS is notified of the new site. <br /> <br /> 6.03 Methane gas levels shall not exceed concentra- <br /> <br />tions of 5 percent on OWNER'S PROPERTY other than identified <br />building sites. <br /> <br /> 6.04 Methane gas levels shall not exceed <br /> <br />concentrations of 5 percent at the boundary of the LANDFILL and <br />OWNER'S PROPERTY. <br /> <br /> ARTICLE VII <br /> <br /> ALTERNATE PERFORMANCE <br /> <br /> 7.01 If the SYSTEM described in Exhibit C has not <br /> <br />reduced the levels of methane gas to the concentrations <br />required by Article VI after three months of continuous <br />operation (but not later than April 15, 1987) or in the <br />CONSULTANT'S determination reasonable progress has not been <br /> <br /> <br />
