Gas Migration Mitigation Agreement <br />September 5, 1986 <br />Page 6 <br /> <br />monitoring wells and the requirement that the migration of <br />methane gas from the LANDFILL shall be controlled as necessary <br />to prevent the creation of any nuisance. PGS agrees to take <br />all actions necessary to prevent the creation of a nuisance on <br />OWNERS' PROPERTY. <br /> <br /> 4.02 CONSULTANT has recommended installation of a <br /> <br />boundary control system (the "SYSTEM") in its report. (See <br />Exhibit C). <br /> <br /> 4.03 PGS agrees to install and maintain the SYSTEM <br /> <br />and monitor methane gas in accordance with the requirements of <br />its closure order No. 78-60. <br /> <br /> PGS shall monitor the wells on the OWNERS' PROPERTY and <br />the LANDFILL to assure that said system will reduce the levels <br />of methane gas consistent with standards set forth in Article <br />VI. <br /> <br /> 4.04 PGS agrees to install the SYSTEM in accordance <br /> <br />with the Performance Schedule set forth in Section 5.01, below. <br /> <br /> 4.05 If monitoring of the SYSTEM reveals that the <br /> <br />standards for performance set forth in Article VI, below are <br />not met, PGS agrees to have a consultant acceptable to the CITY <br />determine what additional mitigation measures are necessary to <br />meet the standards. <br /> <br /> 4.06 PGS agrees to undertake the additional <br /> <br />mitigations recommended by the consultant except as provided in <br />Article VII. <br /> <br /> <br />
