That the deed restrictions for each lot indicate to <br />potential buyers the responsibility of the owners for <br />maintenance and repair of all common areas, roadways and <br />private utility and service systems. <br />42. That the fire hydrant and water system be designed to <br />provide a water flow of 1500 gpm. <br />43. That the fire hydrants and other Fire Department connections <br />shall be located and sized as directed by the City Fire <br />Chief. <br />44. That 20 ft. wide fire retardant buffers shall be provided <br />around site structures on sites 5 through 9. <br />45. That all exterior roofing and siding of all structures <br />shall be fire retarding. <br />46. That all landscaping of the sites 5 through 9, 13, 14, <br />15 through 18 complement the natural setting and limit <br />the use of water for irrigation in order to minimize <br />water saturation. <br />47. That all private roadways and private utility systems on the <br />project site shall be owned, maintained, and repaired and <br />operated by the homeowners association. <br />48. That prior to the filing of a final map, the CC&Rs for the <br />project shall be approved by the City Attorney. The CC&Rs <br />shall provide for a homeowners association with sufficient <br />power to manage the common open space areas, and operate <br />and maintain all commonly owned areas and facilities. The <br />budget, bylaws, and accounting systems shall also receive <br />City staff approval before a final map may be filed. <br />49. That the CC&Rs shall provide: <br />a. that the City be granted an irrevocable right- <br />of-entry for public safety and municipal purposes; <br />b. that if the project is to contain any private utility <br />systems, the homeowners association shall maintain <br />at all times, a contract with a private or public <br />entity, approved by the City, to maintain, repair <br />and inspect those systems. Such maintenance contract <br />shall provide that the Contractor file with the City <br />Engineer semi-annually or annually a report certifying <br />that those systems are in good repair and being pro- <br />perly maintained. The Contractor shall report all <br />problems, wear and tear on the systems, and expected <br />future service needs; and <br />
