<br />Item 5a <br />Staff Report RESOLUTION N0. 1932 <br />PLANNING COb7MISSION EXHIBIT "A" <br />January 14, 1981 <br />SUBJECT: UP-80-35 <br />APPLICANT: Marcia Meyers - TAM Investment Company <br />PURPOSE: <br />ATTACHMENTS <br />Application for a conditional use permit <br />to operate a cocktail lounge in the <br />shopping center under construction at the <br />northeast corner of Hopyard Road and <br />Valley Avenue. 'The property is zoned <br />C-C (Central Commercial) District. <br />1. Site Plan <br />2. Staff Report to <br />dated 12/10/80 <br />the Planning Commission <br />This matter was continued from your meeting of 12/10/80 to <br />allow the applicant to further work with staff regarding <br />parking for the proposed use. At issue during the last <br />meeting was what amount of traffic would be generated by the <br />cocktail lounge during the day. In an attempt to answer this <br />question, five similar cocktail lounges in the East Bay Area <br />were surveyed. Unfortunately, data was received from only <br />three of those businesses. All three respondents operate <br />cocktail lounges approximately the same size as the one pro- <br />posed by Ms. Meyers - around 90 seats. Everyone contacted <br />indicated that day time business was only one-quarter to <br />one-third as great as the night time volume. Applying the <br />one-quarter standard to Ms. Meyers' proposed cocktail lounge <br />of 90 seats would mean that she would need between 7 and 8 <br />parking spaces during the day. Her proportional share (based <br />upon square footage) of parking spaces in the Hopyard Center <br />would be 7.36 spaces. Therefore, if cocktail lounges operates <br />at only one-quarter capacity prior to 5:00 P.M, the 7 spaces <br />available to her should suffice. After 5:00 P.M. when many <br />of the other center businesses are closed, supplying addi- <br />tional parking spaces for her increased business should not <br />be a serious problem. <br />Staff Recommendation: Based upon the foregoing analysis, the <br />staff feels that UP-80-35 can be granted subject to the <br />following conditions: <br />1. That approval of this use permit is for a 2500 sq, ft. <br />or smaller cocktail lounge at the subject location <br />shown on the attached site plan. Said cocktail <br />lounge shall have no more than 90 seats and shall <br />not serve food of any type. <br />
