lane, a combined left-turn through lane and a right-turn <br />lane at the Johnson Drive/Hopyard Road intersection. For the <br />remaining distance west, the developer shall install addi- <br />tional pavement, curb and gutter to provide for a 14 ft. <br />through lane westbound, a 12 ft. left-turn lane into the <br />project, a 12 ft, through lane eastbound, and a 14 ft. <br />free right-turn lane into and out of the project with a <br />separated 8 ft. bike-pedestrian way within the landscaped <br />setback area. The curb to curb width for this section <br />is 52 ft. The exact amount of widening and street improve- <br />ments required to accomplish this shall be determined <br />during final design by the developer's engineer and the <br />City. This work shall be done prior to issuance of a <br />building permit for the first building on the site or in <br />conjunction with the construction of the first building(s) <br />on the property. The City Engineer will have the authority <br />to modify these requirements based on further input from <br />the developer and the developer's traffic engineer. <br />5. That notice shall be given to all commercial users between <br />the subject property and Hopyard Road prior to the com- <br />mencement of street widening. <br />6. That the street widening shall be done as rapidly. as <br />possible and good access maintained to all adjacent <br />property during widening. <br />7. Since construction may commence on the subject property <br />prior to construction on the Meyers property, development <br />of the former shall be allowed as long as the Johnson <br />Drive/Hopyard Road intersection does not reach service <br />level E. The developer shall be required to perform <br />a traffic analysis at time of design review for each <br />newly proposed building to determine whether traffic <br />generated by that building would cause the intersection <br />to reach service level E. If the analysis indicates <br />that level E would be reached, no further development <br />will be allowed until construction has commenced on the <br />Hopyard connection through the Meyers property or other <br />mitigating actions have been taken to ensure that service <br />level E will not be reached at the Johnson Drive/Hopyard <br />Road intersection. <br />8. That the developer shall enter into an agreement with the <br />City agreeing to pay for their appropriate share of an <br />assessment district or districts for the construction of <br />facilities necessary for the amelioration of traffic <br />congestion caused by development on the subject pro- <br />perty.
