Item 6b <br />Staff Report <br />PLANNING COMMISSION <br />April 9, 1980 <br />SUBJECT: UP-80-5 ~~~~e\ <br />APPLICANT: Bank of America <br />PURPOSE: Application for a conditional use permit to <br />extend the occupancy of the Bank of America <br />office located at 6280 West Las Positas Boule- <br />yard. Zoning for the property is C-N (Neighbor- <br />hood Commercial) District. <br />ATTACHMENTS: 1. Location Map <br />2. Site Plan <br />3. Photographs <br />On November 13, 1974, the Planning Commission approved a conditional <br />use permit to allow the establishment and operation of an interim <br />Bank of America office at 6280 West Las Positas Boulevard. The <br />use permit was granted for a period of five (5) years-from the <br />date of occupancy of the structure and lapses on May 8 of this <br />year. Bank of America is now applying for a new use permit to <br />extend the use for an additional five year period. <br />The reason for restricting the life of the original use permit <br />is that the bank is housed in a temporary structure and it was <br />felt that temporary approval would be prudent in order to encourage <br />the bank to build a permanent facility once the office had become <br />established. At the time of original submittal, the bank indicated <br />that by interim they meant five to ten years. They are now seeking <br />the additional five year approval. <br />Staff Recommendation: Although the bank office is in a modular <br />structure, it is not an unattractive building. Additionally, the <br />use seems to function smoothly in its location. For these reasons, <br />we recommend approval of case UP-80-5 subject to the following <br />conditions: <br />1. That this conditional use permit is granted for a period <br />of five years from the date of approval and that at the <br />end of that five year period the use must either cease <br />and the structure be removed or the bank reapply for a <br />new use permit or submit a proposal for some other use <br />of the structure. <br />
