planned and that the reconstruction of the Hopyard Road/I-580 <br />interchange take place in an orderly and safe manner. In order <br />to allow Delta time to perfect plans and studies and to provide <br />for orderly development of the Pleasanton Park Business Center <br />with the least amount of adverse impacts resulting from Hopyard <br />Road/I-580 interchange reconstruction, the parties have reached <br />an agreement concerning rental value of the subject land for <br />Owens Drive road extension, the expiration date of the sewer <br />connection permit transferred by DSRSD to the City, and <br />expiration date for Design Review Approval, pursuant to City <br />Resolution No. 86-111, and now desire to set forth their mutual <br />understanding and agreement pertaining thereto in writing. <br /> <br /> DELTA AND CITY, in consideration of the above-stated <br />recitals, agree as follows: <br /> <br /> 1. The City agrees to extend for the time period described <br />in Paragraph 7 the design review approval granted pursuant to <br />City Resolution No. 86-111, which approved approximately 108,738 <br />square feet of an office, retail, and restaurant complex located <br />in Delta's Pleasanton Park. It is mutually agreed pursuant to <br />the Pleasanton Municipal Code Section 18.20.110, entitled "Lapse <br />of Approval," the design approval would have been void on <br />March 18,1987, unless a building permit is issued and <br />construction had been commenced and diligently pursued toward <br />completion or unless a request for approval extension had been <br />granted by zoning administration. Delta shall have two hundred <br />seventy (270) days after the restoration completed as described <br />in Paragraph 7 of this agreement to obtain building permits <br /> <br /> - 3 - <br /> <br /> <br />
