(C) If an equipment defect is the result of conditions <br /> not disclosed to the CONTRACTOR at the time of system <br /> design, or improper handling by the OPERATOR, or a <br /> change in plant conditions, the charges incurred for <br /> necessary changes, repairs, or adjustments shall be borne <br /> by the OPERATOR. The CONTRACTOR shall replace <br /> equipment subject to normal deterioration such as <br /> batteries, explosive devices, etc., and the expense of <br /> such replacement shall be borne by the OPERATOR. <br /> <br /> (D) The CONTRACTOR, in the event of actuation of the <br /> protection system, shall provide service personnel to <br /> inspect the installation and recommend the reconditioning <br /> and/or replacement of equipment necessary to return the <br /> protection system to its original state. Costs for <br /> reconditioning and/or replacement to be borne by the <br /> OPERATOR. The system shall not be placed in operation <br /> unt!l final inspection has been performed. A report shall <br /> be forwarded as stated in Paragraph i (A) outlining the <br /> work performed. <br /> <br /> (E) The CONTRACTOR shall provide emergency service on <br /> a 24 hour basis for service calls related to circuitry trouble <br /> conditions and/or alarm conditions. <br /> <br /> Calls by the OPERATOR for service other than repair, <br /> maintenance, and alarm conditions, shall be billed at $60.00 <br /> per hour, portal to portal. Calls requested after regular <br /> hours shall be billed at overtime rates. <br /> <br /> II. The OPERATOR shall advise the CONTRACTOR of any changes <br /> made in the equipment, operating procedures, installation, or <br /> plant, prior to the incorporation of such changes. This Contract <br /> shall not cover the charges for any work performed by the <br /> CONTRACTOR necessary to render the system satisfactory for <br /> the changed conditions. <br /> <br />III. The term of this Contract shall be for a period of one (1) year, <br /> beginning on the date of execution, unless sooner terminated <br /> by either party as provided herein. <br /> <br /> Page 2 of 3 <br /> <br /> <br />
