IV. The amount to be paid by the OPERATOR upon execution of <br /> this Contract for the services to be performed by the CONTRACTOR <br /> is Five Hundred Dollars ($500.00) per year .(payable semi-annually). <br /> On contracts covering a period of more than one year, all terms <br /> and conditions shall remain the same with the only exception <br /> being the yearly charge which will be a matter of negotiation. <br /> <br /> V. This Contract shall remain in force from the date of execution <br /> by CONTRACTOR and may be terminated by either party upon <br /> thirty (30) days written notice. <br /> <br />In the event the settlement of any controversy or claim arising out of <br />or relating to this agreement as to breach thereof cannot be concluded <br />by the parties to this Service Contract, they shall resort to arbitration <br />upon written request one to the other. Such arbitration shall be in <br />accordance with arbitration rules then in effect of the California Judicial <br />Arbitration, Code of Civil Procedure, Section 1141.10, et seq. and both <br />parties agree to abide by any decision resulting from such arbitration. <br /> <br />In the event arbitration or legal action is brought by either party to this <br />Contract, the prevailing party shall be entitled to costs and attorneys' <br />fees which will be made part of the award judgement. <br /> <br />The laws of the State of California apply and bind the parties in any and <br />all questions arising hereunder, regardless of the jurisdiction in which <br />any action or proceeding may be initiated or maintained.
