' District along the existing streets known as Johnson Industrial Drive and <br /> Stoneridge Drive, all of which facilities are shown on the'Sketch marked <br /> Exhibit "A", attached and made a part hereof. <br /> <br /> C. The overhead facilities to be removed and the Electric <br /> Facilities to be installed are to be constructed by PGandE. <br /> <br /> D. The ownership of the Electric Facilities, Electric Relocation <br /> Facilities and a portion of the Street Lighting Facilities shall vest in <br /> PGandE, as authorized by the provisions of Sections 5898.9, 10109, 10110 <br /> <br /> and 10111 of the Streets and Righways Code of the State of California. <br /> NOW, THEREFORE, IT IS ~3TUALLY AGREED AS FOLLOWS: <br /> <br /> 1. City shall pay to PGandE upon demand, and prior to any <br /> cons~ruction by PGandE, the nonrefundable amount of $1,974 which represents <br /> PGandE's cost to temporarily raise low voltage cables on poles to enable <br /> Pacific Bell to raise its cables to provide construction ground clearance. <br /> <br /> 2. City shall pay to PGandE upon demand, and prior to any <br /> construction by PGandE, the nonrefundable amount of $48,7?8 which <br /> represents PGandE's cost to relocate existing underground Electric <br /> Relocation Facilities to accommodate the street widening of Johnson <br /> Industrial Drive and the widening of the intersection of Johnson Industrial <br /> Drive and Stoneridge Drive. <br /> <br /> 3. City shall pay to PGandE upon demand, and prior to any <br /> construction by PGandE, the amount of $8,244 which represents the temporary <br /> work by PGandE which has been necessitated by the4 unavailability of a <br /> rights of way to be granted by the United States Department of the Army. <br /> This amount is to be refunded to City should this work not be performed. <br /> <br /> 4. PGandE, upon fulfillment of City's obligations under <br /> <br /> Sections 5 and 6, shall furnish and install the remainder of the Electric <br /> Facilities as shown on Exhibit "A", in accordance with Section B of its <br /> <br /> <br />
