7, That the developer dedicate to the City slope easements <br />as required by design along Bernal Avenue and Foothill <br />Road. <br />8. That the developer show on the parcel map and thereby <br />establish a 40' building setback line parallel to and <br />contiguous with the top of bank of the Arroyo de la <br />Laguna taken as the existing fence line. <br />9. That the developer pay any and all fees that this parcel <br />may be subject to, including in-lieu park dedication <br />fees. <br />10. That the developer install two standard fire hydrants <br />at locations determined by the City Engineer. <br />11. That any damage to street improvements now existing or <br />done during construction on the subject property be re- <br />paired at full expense to the developer. <br />12. That the developer submit a site development plan in <br />accordance with the Survey Ordinance (Article 3, Chapter <br />3, Title II) and that these plans be approved by the <br />Director of Engineering Services prior to issuance of <br />a building permit. <br />13. That the site development plan include all required <br />information to design and construct site grading, paving <br />and drainage. <br />14. That all the utilities required to serve development be <br />installed underground. <br />15. That the applicant enter into an agreement with the <br />City whereby he agrees to construct or finance the con- <br />struction of street improvements adjacent to the site <br />to the extent required by the now current Subdivision <br />Ordinance at such time in the future as this is deemed <br />necessary by the Director of Engineering Services. Said <br />improvements to include, but are not necessarily limited <br />to, grading, curb and gutter, sidewalk, paving, and a <br />proportionate share of the cost of incidental street im- <br />provements (exclusive of costs of signals, and bridge). <br />This agreement to be executed and approved by the City <br />Council prior to the approval of the parcel map. The <br />intent of the City is to have applicant or applicant's <br />successors participate in the future improvement and <br />widening of Foothill Road and in the future improvement <br />and widening of Bernal Avenue, when undertaken by the <br />City and/or the County of Alameda. _ <br />-2- <br />
