h. City will insure appropriate energy conservation <br /> practices are followed within the Theater. City shall adopt and <br /> follow reasonable energy management policies as suggested by <br /> District. Both agencies shall cooperate to insure adequate <br /> sanctions for failure to follow energy management policieS. <br /> <br /> 6. .Operational Costs: District Responsibility. <br /> <br /> a. District shall provide and pay for utilities, <br /> including gas, electricity, water, sewer and trash,as reasonably <br /> necessary on a year-round basis. <br /> <br /> b. District shall be responsible for obtaining fire <br /> and extended insurance coverage (i.d. earthquake) in an amount <br /> equal to ninety percent (90%) of the full replacement cost new, <br /> including building contents. City will reimburse District for <br /> fire insurance costs allocating prorata on a square foot basis <br /> for the other portion of the building currently being used as the <br /> girls gymnasium. Any insurance proceeds shall be applied to <br /> reconstruction of the Theater to the extent feasible. <br /> <br /> c. District shall maintain exterior grounds adjacent <br /> to the Theater. <br /> <br /> d. District agrees to repay City if District users <br /> damage the facility or if the custodial time required to clean <br /> the facility during or after District use is beyond normal due to <br /> lack of user cleanup. <br /> <br /> e. District will cooperate to make Amador High School <br /> parking available to persons attending events at the Theater and <br /> will exercise best efforts to obtain cooperation for overflow <br /> parking to locate at Alisal School. The provisions of this <br /> section will be applied in accordance with paragraph 4(b) above. <br /> <br /> 7. Capital Improvements. <br /> <br /> During the term of this agreement, City can make capital <br /> improvements and add fixtures to the Theater subject to the <br /> following limitations: <br /> <br /> a. Any structural change which requires the approval <br />of the State Architect's Office shall first be submitted to the <br />District Board of Directors for its approval. <br /> <br /> b. Any change in the exterior appearance of the <br />Theater excluding those exterior changes already contemplated in <br />conjunction with the Amador Theater renovation, but including any <br />exterior sign plan, shall first be submitted to the District <br />Board of Directors for its approval. <br /> <br /> 8. Beverage Restrictions. <br /> <br /> a. No alcoholic beverages may be sold, served or used <br />during any events scheduled by the District pursuant to Section <br />2. <br /> <br /> - 4 - <br /> <br /> <br />
