the Auf der Maur Parcel. At the option of the Landowner, the <br />Bernal Avenue Extension may be financed by an acquisition assess- <br />ment district to be formed by the City. Also at the option of <br />the Landowner, the Bernal Avenue Extension may be constructed at <br />reduced width by eliminating the outside two lanes along its en- <br />tire length if a PUD application for the Shopping Center Parcel <br />has not been submitted to the City by the July 1, 1987 date. <br />Whether or not the Shopping Center Parcel develops, Landowner <br />agrees to dedicate the full right-of-way width required for the <br />ultimate planned Bernal Avenue in conjunction with the formation <br />of the Bernal Avenue Extension Assessment District. Pursuant to <br />its police power, the City may require construction of the <br />remaining lanes of Bernal Avenue if determined necessary in con- <br />junction with subsequent discretionary project approvals on the <br />Auf der Maur Parcel. <br /> <br /> c. Temporary Storm Drain Easements. Landowner agrees <br />to grant rights of entry as necessary to construct storm drain <br />lines from the Valley Avenue Extension grade separation to the <br />Arroyo del Valle within the proposed right-of-way for the pro- <br />posed Bernal Avenue Extension. <br /> <br /> d. Storm Drain Lines. The City will include in the <br />Valley Avenue Extension Project a storm drain line within the <br />temporary storm drain easement described in Paragraph 4(c). The <br />storm drain line will be of sufficient size to accept anticipated <br />storm drainage from development of the Auf der Maur parcel.
