Assessments for purposes of <br /> this limitation shall not include land dedication, street con- <br /> struction, signalization cost, or undergrounding costs which <br /> Landowner agrees to undertake pursuant to paragraphs 3, 4, 5, 6, <br /> 7, 8 and 9 of this contract. <br /> <br /> 3. Dedication of Stanley Boulevard Frontage. Landowner <br />agrees to dedicate to the City, at the time determined necessary <br />by the Public Works Director, Parcels as shown on the attached <br />Exhibits "C" and "D" for construction of the Valley Avenue Exten- <br />sion. One parcel is the 8,538 sq. ft. parcel more particularly <br />described in Exhibit "C" attached hereto. The second parcel is a <br />34,398 sq. ft. parcel more particularly described in Exhibit "D" <br />attached hereto. <br /> <br /> 4. Construction of Bernal Avenue. <br /> <br /> a. If Shopping Center Parcel Develops Now. In con- <br />junction with development of the proposed shopping center parcel, <br />Landowner agrees to construct the proposed Bernal Avenue Exten- <br />sion in the appropriate configuration shown on Exhibit "A". <br /> <br /> b. If Shopping Center Parcel Develops Later. If a <br />contract for construction of the Bernal Avenue Extension has not <br />been let by Landowner by July 1, 1987, then the City may under- <br />take all necessary steps to form an assessment district for the <br />construction of the Bernal Avenue Extension. Landowner agrees to <br />cooperate in such effort by granting rights of entry as needed <br />for engineering design and agrees to support the formation of an <br />assessment district in which 100% of the costs shall be borne by <br /> <br /> - 4 - <br /> <br /> <br />
