Section 10. Sick Leave <br /> <br /> 10.1 Sick Leave Aocrual <br /> <br /> During his/her first year of employment each new full <br /> time employee shall earn sick leave at the rate of eight <br /> (8) hours for each month of service. Upon successfully <br /> completing his/her one year probationary period each new <br /> employee shall receive three hundred eighty-four (384) <br /> hours sick leave credit in addition to that earned <br /> during probation. Upon completion of five (5) years <br /> service, every employee shall thereafter accumulate sick <br /> leave at a rate of eight (8) hours per month. No <br /> employee shall accumulate more than one thousand four <br /> hundred forty (1,440) hours sick leave. An employee may <br /> be allowed a sick leave deficit of twenty four (24) <br /> hours beyond that actually earned. Employees on leave <br /> of absence with pay in lieu of temporary disability <br /> payments pursuant to Section 4850 of the Labor Code <br /> shall accumulate sick leave during said leave of <br /> absence, in accordance with the provisions of this <br /> section. <br /> <br /> 10.2 Sick Leave Usage <br /> <br /> Sick leave with pay shall be granted to all probationary <br /> and permanent full time employees within the competitive <br /> service. Sick leave shall not be considered a right <br /> which an employee may use in his/her discretion but <br /> shall be allowed only as follows: <br /> <br /> 1) In cases of necessity and actual personal sickness <br /> or disability of the employee. <br /> 2) For medical and dental appointments of the <br /> employee, at the discretion of the immediate <br /> supervisor. <br /> 3) For the care of or attendance upon the sickness or <br /> disability of members of his/her immediate family <br /> or for bereavement because of the death of a member <br /> of his/her immediate family. A maximum of forty <br /> (40) hours per year of sick leave may be used for <br /> this purpose. The immediate family shall consist <br /> of the spouse, children, parents, brothers, sisters <br /> or other individual whose relationship to the <br /> employee is that of a dependent or near dependent. <br /> The Police Chief shall grant such leave and <br /> determine the amount thereof; provided, however, <br /> that the Personnel Officer shall first, where <br /> necessary, pass upon sufficiency of relationship. <br /> <br /> This provision does not apply if the family <br /> sickness or disability or the employee's <br /> bereavement occurs while the employee is on <br /> vacation leave. <br /> <br />Memorandum of Understanding <br />Page 10 <br /> <br /> <br />
