That the development shall substantially conform to the plans <br />and file with the Planning Department, except as modified by <br />these conditions. <br />2. That approval of this development plan is based upon the City <br />vacating the necessary street right-of-way as shown on the <br />development plans on file with the Planning Department. <br />3. That maintenance of the area between the front property line <br />of the parcels having frontage on Valley Trails Drive and the <br />back of curb shall be the responsibility of the corresponding <br />property owners. <br />4. That the color schemes for the units shall be limited to <br />those shown on the development plans on file with the <br />Planning Department and that adjacent units shall not employ <br />the same color scheme. <br />5. That a final landscape plan for the development shall be <br />submitted to the Planning Director for review and approval <br />prior to the issuance of a building permit and that such a <br />plan shall provide that the developer shall be responsible <br />for the installation of landscaping in the front yards of all <br />units having frontage on Valley Trails Drive, in the area <br />between the driveway and the sideyard areas of the two <br />adjacent units, and in the area of the adjacent City <br />right-of-way west of the project and that maintenance of same <br />shall be the responsibility of the homeowners association. <br />6. That a fencing plan shall be submitted to the Planning <br />Director for review and approval prior to the issuance of a <br />building permit and that this plan shall provide for adequate <br />landscape side yard setback areas for the parcels abutting <br />the entry to the private driveway at Valley Trails Drive. <br />7. That the developer shall +~pply for and receive subdivision <br />approval from the City for the project. <br />8. That a homeowners association shall be established to <br />maintain the private driveway and the adjacent City <br />right-of-way area west of the project, with the <br />responsibility for the former to be apportioned among the <br />five interior property owners and the maintenance of the <br />latter to be apportioned among all owners; such provisions <br />for the association shall be submitted for review and <br />approval by the City Attorney and the City Engineer prior to <br />recordation of the final map. <br />- 3 - <br />
