B. The site is situated within a <br />developing business park. There are adjoining <br />residences to the north (300 ft. away) which will <br />be separated by the Arroyo del Valle and <br />recreational easement. The distance separating the <br />two uses, together with the planned intensive <br />landscaping along the Arroyo del Valle, should <br />screen any potential nuisances (such as noise) <br />created by children in the play area. There will <br />be offices and/or research and development <br />facilities to the west, east, and south of the <br />site. Those business uses will not be adversely <br />affected by noise from the day care facility since <br />they are conducted mainly indoors, and the interior <br />noise levels will conform to the City's Noise <br />Ordinance. The traffic report prepared for the <br />project concludes that there will be no significant <br />traffic impacts. <br />The City did approve day care facilities in <br />Hacienda Business Park (200 children) and on <br />Brockton Drive (156 children). Staff has never <br />received any complaints from the adjoining <br />residences. or businesses regarding the operation of <br />those facilities. <br />C. That the proposed conditional use will comply with <br />each of the applicable provisions of this chapter. <br />The proposed day care facility will comply with all <br />provisions of Title 18 of the Pleasanton Municipal <br />Code. <br />WHEREAS, an environmental impact report was prepared for the <br />rezoning and PUD approval for this business park. A <br />specific project of this type was included within the <br />scope of that EIR. Therefore, no further environmental <br />document was considered at this time. <br />NOW, THEREFORE, THE PLANNING COMMISSION OF THE CITY OF PLEASANTON <br />RESOLVES AS FOLLOWS: <br />Section 1. Approves Case UP-86-53, application of West States <br />Development Co./Bernal Avenue Associates as herein <br />described subject to the following conditions: <br />- 2 - <br />
