2. Findings. <br />a. The City Council finds that pursuant to <br />AB 2926, the mazimum mitigation which may required is_the <br />imposition of a x1.50 per square foot school impact fee. In <br />addition, pursuant to AB 2926, the City may not impose <br />additional fees or ezactions, or deny the approval of the <br />Project, based on its impact on school facilities. <br />b. The imposition of a school impact fee <br />in the amount of X1.50 per square foot of habitable residential <br />space, together with the other measures incorporated into this <br />Project, have mitigated or will mitigate school impacts of the <br />Project to a level of insignificance. <br />c. This City Council finds that this <br />Project does not include an amendment to the City's general <br />plan. Accordingly, the proposed additional mitigation measure <br />by its own terms does not apply. <br />P. Recreation. <br />1. Facts. <br />The DEIR notes at page 77 that the Project includes <br />the dedication of a four (4) acre park around the Alviso Adobe, <br />which park would include the identified Native American site <br />and a potential area proposed as a reburial ground for human <br />remains. The DEIR states on page 77 that this park, together <br />with associated greenways and paths, would provide city-wide <br />benefits. The Final EIR notes on page 23 that the Project, as <br />revised, includes a neighborhood park consisting of five (5) <br />33 <br />
