o Take immediate action to provide screening to the neighbors at the <br />rear by implementing landscape installation as a part of the approved <br />2001 project. <br />The applicant assured the Zoning Administrator and the neighbors that he <br />has obtained the funding to complete the project. The project contractor <br />stated that asix- to eight-month period would allow him to deliver a quality <br />product. <br />July 12, 2007: Although a set of construction drawings was sent to each neighbor for <br />review and comments prior to the hearing, the applicant did not provide a <br />construction timeline until the hearing date. Thus, the Zoning Administrator <br />continued the hearing to July 20, 2007 so that the neighbors would have <br />adequate time to review the proposed construction schedule. <br />Additionally, in response to the construction performance bond issue, staff <br />was advised that these bonds are commonly required for Capital <br />Improvement Projects where in case the contractor failed to complete the <br />job, the City, as the property owner, could use the bond amount to complete <br />the project. In this case, the site is owned by a private party; therefore, <br />cannot be requested. <br />July 20, 2007: The neighbors continued to feel that they have been misled by the applicant <br />through the entire project. They did not believe that they could support the <br />additions in question if it were brought to their attention through the proper <br />process. The neighbors thus requested the following: <br />o Install full-size trees (approximately 20 feet in height) to provide <br />screen for the project being viewed from the Leete's and the Longs. <br />o Remove the half-moon shaped window on the west (rear) elevation. <br />o Remove all unpermitted structures/additions. <br />o Complete all exterior work by October 31, 2007. <br />The City's Landscape Architect has reviewed the landscape plan submitted <br />by the applicant and found that the proposed species are appropriate for the <br />area and that the trees, when mature, would provide the desired screen to <br />the Leetes and the Longs. <br />Construction Timeline <br />Construction at the Smith's started in 2002. This owner-builder project has lasted longer than <br />the neighbors have expected.
