In March 2007, the Smith's submitted an administrative design review application (Case No. <br />PADR-1698) for the additions that are under construction. <br />~ : ~~; <br />~,~,._ .. <br />The Current Project (PADR-1698 <br />As shown, the proposed modifications are above the existing garage and to the left side of the <br />house. Due to its location and one-story height, the addition to the left side of the house is not in <br />a plain view of the rear neighbors (see aerial on pg. 5). The second floor addition at the front <br />does not appeared to be a visual impact to the rear neighbors. This addition is more visible from <br />the neighbor to the right. Given that it is in an alignment with the neighbor's garage, it is not <br />considered by staff to be a visual impact to the neighbor to the right. With respect to privacy, the <br />windows are above five feet from the floor and the Smith's will not be able to look out at the <br />neighbor's. <br />The duration of the construction activities at the Smith's prompted the neighbors to raise <br />objections to this administrative design review application. The neighbors felt that they were <br />misled and misinformed by Mr. Smith regarding the original scope of the 2001 approval. They <br />did not expect that the construction take such a long time and that their privacy would be <br />significantly impacted by this addition. <br />The Zoning Administrator held three hearing on May 17, 2007, July 12, 2007 and July 20, 2007. <br />On July 20, 2007, Zoning Administrator found that the additions, despite the fact of they were <br />constructed without prior approval and permit, conform to the zoning regulations in terms of the <br />setbacks, building height, and maximum allowable Floor Area Ratio.
