Has the City of Pleasanton redefined fowl contrary to the State Ag Codes Sections 24652, 25403, 24952, <br />57503 and the Alameda County Ag Code permitted use section 17.26.030 to include wild raptors? If so, <br />what legal precedent or legal definition was used for this new and apparently unique definition? If not - <br />please help me understand how the applicant has not been in violation of municipal code and possibly the <br />PUD and/or CCBRs in place for the residence since 2005 and why doesn't Municipal Code Section <br />18.140.010 apply? <br />2. The applicant apparently obtained a building permit for the wild animal enclosure in 2005. Can I get a copy <br />of that permit and any and all documentation that is publicly available on the internal review and granting of <br />that permit? <br />3. What PUD and/or Homeowner Association CCBRs is in place for this residential property? Can I please <br />obtain a copy if there are governing agreements? Was a CUP required to place an out-building on the <br />property and was that reviewed and granted at the time of the permit w.r.t. setbacks, size, neighbors input, <br />etc. <br />4. Are there other CUPs, PUDs or other code modifications for wild raptors or other wild animals in <br />Pleasanton? If this is a unique or first time/type application -why was this placed on the consent calendar <br />vs. having a public hearing? <br />5. For the past five years -can you please provide a list of all animal applications -the name of the applicant <br />and animal(s) in question, the application date -the date the application was granted or denied, whether or <br />not there was an appeal and whether or not the animal in question was allowed to be on the property until <br />the process was complete? <br />6. How is this application being handled when compared to how previous 4H children's applications and the <br />recent Hatsushi application as all of these related to Municipal Code sections 18.32.030, 18.32.040, and <br />7.36.010 and 7.36.040 or specific additional PUDs? <br />7. Can I obtain a copy of the Federal and State License/Permit that the applicant claims to have regarding <br />this use? Has the city reviewed those licenses, confirmed current validity, and confirmed the initial grant <br />dates and date of expiration? <br />8. Please type "hawk attacks" into your Google search engine and please look through the links that come <br />return to your screen on the search. There are several pages of documented news articles on hawk <br />attacks on humans and pets. Given this data, isn't there a defined safety risk in this application in general <br />and doesn't that risk exist while this application is in process?
