I hope you can honor your verbal commitment to
me that "it shouldn't take two weeks to pull these data together." As more than two weeks have already passed, I
would like to re-document the specific requests:
1. A copy of the applicant's building permit paperwork, documentation, approvals for the raptor outbuilding
built several years ago.
2. A copy of the PUD in force for the applicant's property
3. For the past five years -can you please provide a list of all animal applications the City has received -the
name and contact information of the applicant and animal(s) in question, the application date -the date the
application was granted or denied, whether or not there was an appeal and whether or not the animal in
question was allowed to be on the property until the process was complete?
4. A copy of the Federal and State License/Permit that the applicant claims to have regarding this use. Has
the City reviewed those licenses, confirmed current validity, and confirmed the initial grant dates and date
of expiration? If so, copies of ail verification documentation would be appreciated -including reports from
those who have inspected the property.
5. A written position from the City regarding the safety ooncems of a wild raptor in a residential neighborhood,
what will be disclosed to the surrounding property owners and what they will need to legally disclose on
any future real estate transactions under Calffomia law.
6. Copies of all correspondence between the City and the Applicant regarding this process, including any e-
mails between the City Attorney, City Manager and Planning Department Staff and the applicant in terms of
decisions on this issue -those documents should be part of the public record ff they pertain to the
application. It is my understanding that there should have been at least one formal letter indicating the
applicant was in violation of the municipal code and needed to rectify the situation. If that letter does not
exist, I would request a formal explanation from the City as to why.
I look forward to hearing from the City as to when these requests can be honored. In my opinion, these data
should have been part of the application review packet and readity available for the Planning Commissioners to
review prior to any hearing or (consent calendar) vote on this application.
Best Regards -
11/5/2007
